Jurisprudential Trends in Justifying the Principles of the Idea of “Responsibility of Destruction”

Abstract
The liability or risks that threatens the buyers results from the destruction of the thing sold after concluding the sales contract and before it is actually delivered to him. The principle of destruction is rooted on the basis of the general rules of impossility of implementation, because the obligation that is impossible to implement is the obligation whose implementation is due to a foreign cause, and it cannot be implemented. For the contracting parties, such as force majeure or a sudden accident, which causes the contrac to be terminated by force of law and the obligation of the other party is dropped. Determining the liability is intended to determine who bears the loss that is supposed to reasult from the lossdue to the impossibility of performance. The legal relationship does not end until the identity of the party who bears the consequences of the loss is determined.
